23. Authorize the executive director to sign an agreement with Whatcom County for real estate services? Whatcom County owns a building at 3720 Williamson Way in the airport’s industrial park (see the County Council meeting on 7/27/2010, votes 134 and 137) and the Port of Bellingham owns the property. The building was constructed with funds that require the use by persons with disabilities or other employment barriers. The building, recently vacated after a five-year occupancy by Chinook Enterprises, is approximately 10,000 square feet. Once leased, the port shall receive 20 percent of building rent, estimated to be $1,000, and ground rent, estimated to be $1,500 per month. (6655/Action Item 1) Approved 3-0

24. Authorize the executive director to sign a $9,750 contract (amendment #2) with K Engineers of Lynden for construction administration support services for the Squalicum Harbor Gate 3 electrical upgrades project? At the 6/16/2015 meeting, vote #81, K Engineers was awarded a contract to evaluate the electrical systems at Blaine Harbor and Squalicum Harbor and provide recommendations for upgrades. K Engineers has completed design of electrical upgrades. The upgrade will improve service to marine customers and bring the port into compliance with the National Electric Code. This amendment brings the total authorized contract to $82,350. (6657/Consent Agenda B) Approved 3-0

25. Modify leases with Avis Rent A Car System, Budget Rent A Car System, EAN Holdings (Enterprise) and The Hertz Corporation? The Hertz Corporation began renting vehicles at the Bellingham airport in January 1986; Budget Rent A Car in March 1986; Avis Rent A Car in March 1989 and Enterprise Rent A Car in May 2002. These modifications are effective 3/1/2017, and relocate the rental car return pickup to the southern portion of the terminal lot near the rental car counters and baggage claim exits. This southern location results in about 75 additional stalls for a total of 257 stalls. Each agency is responsible for relocating its signage at its own expense. Nominal rent is $57,140 for the remaining ten months of these lease and concession agreements. Avis will pay $10,885; Budget will pay $8,325; EAN will pay $23,525; and Hertz will pay $14,405. 26. Authorize the executive director to award the low bid of $402,437 to Elite Electrical of Bellingham for the Squalicum Harbor Gate 3 electrical upgrades? The upgrade will improve service to marine customers and bring the port into compliance with the National Electric Code. Two bids were received, the high bid was $469,025. The estimated completion date for the project is 5/1/2017. A contingency fee of $40,243 brings the total authorized contract to $442,680. (6659/Action Item 2) Approved 3-0

27. Authorize the executive director to sign a temporary occupancy release and indemnification agreement with All American Marine and RAM Construction? Unforeseen delays have extended the completion date of the new manufacturing facility to 3/10/2017. The $9,317,000 contract with RAM Construction was approved at the 5/3/2016 meeting, vote #81. This action will allow All American Marine to make tenant improvements in the office area and begin vessel construction in order to meet its contractual obligations. Action Taken at March 7, 2017 Meeting
Shall the commission:

28. Award 2017 small city economic development fund grants totaling $65,000 to Blaine, Everson, Ferndale and Lynden? The port started the small city grant program in 2004. The port provides matching funds to small cities for economic development. The city of Blaine will receive $15,000 for design of access to a west side alley off Peace Portal Drive. The city of Everson will receive $20,000 for engineering support of Lincoln Street improvements. The city of Ferndale will receive $15,000 for development of new business and visitor signs. The city of Lynden will receive $15,000 for professional services in evaluating reclamation and reuse of a closed city landfill. The applicants are providing $65,000 in matching funds. (6665/Action Item 1) Approved 3-0

29. Authorize the executive director to accept a $192,254 federal grant for a commercial pumpout system at Squalicum Harbor? In 2016, the state Department of Ecology offered a one-time grant opportunity to provide funding for new vessel sewage disposal facilities or pumpout stations in Puget Sound for commercial vessels. The port applied for and was awarded a grant to fund a new sewage pumpout station for the Squalicum Harbor sawtooth dock. This grant is funded by the Environmental Protection Agency. The grant will provide the design, purchase, and installation of a new sewage pumpout system. (6666/Action Item 2) Approved 3-0

30. Declare the acid ball surplus and transfer it to the city of Bellingham? The port and city worked to complete and adopt a Waterfront District Sub-Area plan in 2013; this plan recommended salvage of historic materials and artifacts, and display of these in new buildings and open spaces. The port has temporarily preserved a large metal acid ball on the Georgia Pacific site. The acid ball no commercial value or practical use other than as public art. The city is designing the Whatcom Waterway Park, and has requested that the port transfer ownership of the acid ball to the city for display in the new park. 6667/Action Item 3 (Resolution 1361) Approved 3-0

31. Authorize the executive director to sign a release and settlement agreement with the port’s additional insurer Progressive Classic Insurance Company? Roger Schjelderup was required to name the port as an additional insured on his yacht insurance policy under Progressive. Schjelderup moored his yacht in the Squalicum Harbor boathouse. After the boathouse fire on 3/30/2012, Starr Indemnity & Liability Company undertook the defense of the port in various state and federal lawsuits. Schjelderup’s insurance company, Progressive Classic Insurance Company agreed to participate in the port’s defense. The port and Progressive have reached an agreement for Progressive to issue a payment of $130,685 to Starr to offset defense costs paid by Star. (6668/Consent Agenda B) Approved 3-0

32. Authorize the executive director to sign a $6,090 contract (amendment #9) with Moffatt & Nichol of Seattle for work on the Georgia Pacific portion of the Whatcom Waterway pier? At the 4/21/2015 meeting, vote #62, the commission approved the initial contract with Moffatt & Nichol for pier work at the Bellingham Shipping Terminal. This amendment provides cost estimates for two proposals being considered for future utilization of the pier. A contingency fee of $609 brings this amendment to $6,699 and the total amended contract to $441,220. (6669/Consent Agenda C) Approved 3-0

33. Authorize the executive director to sign an agreement with the state of Washington to fund a portion of the Whatcom Waterway Park beach? This agreement falls under the Bellingham Bay Demonstration Pilot project; under the project, occasional funding is provided by the state Department of Ecology for ongoing coordination with other agencies, as well as for specific habitat restoration projects. This agreement will include removal of pavement, fencing, a vertical wooden bulkhead and retaining wall adjacent to Central Avenue and the Whatcom Waterway. The shoreline will be regraded to create a soft-bank beach which is fish-friendly. Under this agreement, the state will reimburse the port for 100 percent of eligible project costs up to $143,022. Action Taken at March 21, 2017 meeting
Shall the commission:

34. Authorize the executive director to award the low bid of $12,488,739 to IMCO Construction of Bellingham for the Harris Avenue Shipyard interim action cleanup? Six bids were received, the high bid was $19,263,836. At the 2/16/2010 meeting, vote #37, the commission authorized the executive director to sign an agreed order with the state of Washington to perform a complete site-wide remedial investigation/feasibility study. During the RI/FS process, the port and state identified the need for an interim action to remove contaminant sources. Approximately 10,100 cubic yards of contaminated sediments and 1,300 cubic yards of contaminated upland soils will be removed. Contaminated materials will be disposed of at an off-site facility permitted to accept these materials. IMCO will demolish the Carpenter Building and pier, as well as the 360-foot-long timber portion of Harris Avenue Pier. To accommodate tenant business operations, the in-water cleanup will be completed in two phases: western dredging and associated demolition during the 2017-18 in-water work window, and eastern dredging and associated demolition during the 2018-19 window. Harris Avenue Pier will be replaced with a steel pile-supported concrete pier. The pier will be constructed in two phases: the western half during the 2017-18 in-water work window, and the eastern half during the 2018-19 window. An existing Model Toxics Control Act remedial action grant will reimburse 50 percent of eligible costs. A contingency fee of $229,783 brings the total authorized contract to $12,718,522. 35. Authorize the executive director to sign a $548,450 contract (amendment #13) with Floyd/Snider of Seattle for consulting support at the Harris Avenue Shipyard interim action cleanup? At the 5/6/2008 meeting, vote #66, the commission authorized the executive director to sign a contract with Floyd/Snider to complete the RI/FS of the shipyard. This amendment is for final design revisions, construction management and oversight of sediment and soil removal, confirmation sampling, and interim action reporting. An existing MTCA remedial action grant will reimburse 50 percent of eligible costs. This amendment brings the total authorized contract amount to $2,411,465. (6676/Action Item 2) Approved 3-0

36. Authorize the executive director to sign a $587,482 contract (amendment #15) with BergerABAM of Seattle for construction administration support services and additional design services at the Harris Avenue Shipyard interim action cleanup? Scope of work includes construction administration support services and additional design services to revise project design to include a split-pier demolition and construction procedure that will allow the Shipyard to continue operations. An existing MTCA remedial action grant will reimburse 50 percent of eligible costs. This amendment brings the total authorized contract amount to $2,008,489. (6677/Action Item 3) Approved 3-0

37. Authorize the executive director to sign a $57,744 contract with Pacific Surveying & Engineering of Bellingham for design and consulting services for the extended sidewalk project along Mitchell Way project? The design work is for 3,125 feet of new sidewalk along Airport Way, West Bakerview Road, and Williamson Way. Work along West Bakerview Road and Williamson Way will include curbs and gutters. A contingency fee of $5,776 bringings the total authorized contract to $63,520. (6678/Action Item 4) Approved 2-1, Michael McAuley opposed.

38. Authorize the executive director to sign a $141,250 contract (amendment # 11) with Kennedy/Jenks Consultants of Federal Way for additional design work on the Bellingham Shipping Terminal stormwater improvements? Scope of work includes design of site grading and resurfacing; media filter drains; replacing overhead power lines from the ABCD building to the Block House; upgrading of warehouses’ electrical services; providing new transformerand switchboard for Berth #3; removing overhead power lines along western shoreline;and demolition of the Block House. The contract includes a 10 percent contingency fee, bringing the total authorized contract to $783,699. (6679/Action Item 5) Approved 3-0

39. Declare the vessel “Bligh Island” surplus property and authorize port staff to sell the vessel? At the 1/24/2017 meeting, vote #13, the commission authorized the auction of the 79-foot purse seiner for nonpayment of moorage fees. A public auction was held on 2/17/2017; when no bids were received the vessel title reverted to the port. Proceeds from the sale of the vessel will be used to satisfy moorage charges of $5,264. (6681/Consent Agenda B) (Resolution 1360) Approved 3-0

40. Authorize the executive director to sign eleven remedial action grant agreements (amendment #1) with the state Department of Ecology? At the 3/15/2015 meeting, vote #43, the commission authorized the renewal of nine remedial action grant agreements for the Model Toxics Control Act sites: Blaine Marina tank farm, central Waterfront, Cornwall Avenue landfill, GP Mill, Harris Avenue shipyard, I & J Waterway, Weldcraft Steel and Marine, Westman Marine and Whatcom Waterway. At the 10/4/2016 meeting, vote #164, the port entered into additional agreements for the GP Mill and Harris Avenue Shipyard. This amendments will extend the expiration date of these agreements to 6/30/2019. Ecology will continue providing reimbursement of 50 percent of total grant-eligible remedial costs. 41. Authorize the executive director to sign a one-year service agreement to sell scrap metals? This vote allows the executive director to sell these materials and provide written certification required by Resolution No. 1106-S. While the quantity of scrap metals generated varies, it is estimated that $2,000 to $10,000 worth of scrap metals could be sold throughout a normal year. (6683/Consent Agenda D)Approved 3-0
