176. Authorize the executive director to sign an agreement with the Federal Aviation Administration to transfer $5 million in airport improvement funds to Pullman-Moscow Regional Airport? The Bellingham airport does not anticipate using its improvement funds until FY 2018. Accumulation and carryover of these funds limits the FAA’s ability to meet crucial needs. The FAA allows airport sponsors such as the port to donate entitlement funds to specified airports. (6342/Consent Agenda B) Approved 3-0

177. Authorize the executive director to sign a $421,286 agreement with Whatcom County Fire District #8? The fire district will provide fire protection, emergency medical services, and crash fire rescue support for Bellingham airport. The port has had an agreement with fire district #8 since 1987. This agreement runs from 1/1/2017 through 12/31/2019 with fees of $126,436 in 2017, $139,080 in 2018, and $155,770 in 2019. (6343/Consent Agenda C) Approved 3-0

178. Authorize the executive director to sign a $42,677 contract (amendment #2) with Bennett Engineering of Bellingham to conduct landfill monitoring at the airport woodwaste landfill? The monitoring is required under the National Pollution Discharge Elimination System until 2026 or possibly longer. The contract includes monthly landfill inspections, semi-annual landfill gas monitoring, semi-annual ground and surface water monitoring and reporting, monthly leachate sampling with analysis and reporting, and engineering support to address any deficiencies in landfill or leachate systems. This amendment will bring the total contract amount to $113,310. (6344/Consent Agenda D) Approved 3-0

179. Authorize the executive director to sign a $157,051 contract (amendment #13) with Anchor QEA of Seattle for environmental sampling and reporting at the central waterfront site? The state Department of Ecology has determined that additional sampling and analysis is required of the 55-acre site. The work includes focused field sampling, reporting, and analysis of alternatives in the site feasibility study. Additionally, scope includes construction management associated with cleanup components of the All American Marine project. An existing Model Toxics Control Act grant will reimburse 50 percent of eligible costs. The port’s pre-funded insurance package will cover a portion of remaining costs. This amendment brings the total contract to $1,150,700. (6345/Consent Agenda E) Approved 3-0

180. Authorize the executive director to sign to an agreed order (amendment #1) with the state of Washington to perform engineering design for cleanup actions at the Blaine Marina site? The original agreed order was approved at the 3/6/2012 meeting, vote #43. The property was on the state’s hazardous sites list, petroleum hydrocarbon had been identified in the soil and groundwater and was managed under the Model Toxics Control Act. The original agreed order has been completed; an amendment is necessary to continue cleanup work. The work under amendment #1 includes completion of a pre-design investigation, an engineering design report, design specifications and bid documents. (6354/Consent Agenda H) Approved 3-0

181. Terminate the lease with Blaine Marine Services and approve a new harbor lease with Sundance Marine of Portland, Oregon for premises in Blaine? Sundance Marine (a yacht dealer) purchased Blaine Marine in September. The Blaine Marine lease terminates on 11/1/2016. Sundance has an initial fifty-year lease with conditions; if permits to build a dry-stack vessel storage building fail, the lease will revert to a twenty-five year term. Sundance will pay the port approximately $320,000 in rent for the first five-year lease period. (6349/Action Item 1) Approved 3-0

182. Authorize the executive director to increase by 10 percent (about $203,474) the contract with IMCO Construction of Bellingham for work on the C Street terminal project – phase 1? The contract for $2,034,743 was originally approved at the 7/19/2016 meeting, #125, Phase 1 includes installation of a new concrete roadway, replacement of overhead power and communications cables with underground cables, installation of new stormwater collection and treatment facilities, and installation of new sewer collection facilities. While the project is approximately 25 percent complete, contract contingency funds are nearly used up. A significant amount of work remains to be done in installing utilities. Additionally, with the discovery of more contaminant-impacted soils, port staff expects additional project costs. This increase will raise the total contract from $2,238,217 to $2,441,690. 183. Adopt a revision to the rental revenue standards for 2016 to include criteria for tenant-requested rental relief? The 2016 rental standards were adopted at the 1/5/2016 meeting, vote #5. A new addition to the standards allows a port tenant in good standing facing financial difficulties to apply for and receive up to 24 months of rent relief on a maximum 67 percent of rent, subject to commission approval. A review committee comprised of the executive director, real estate director and finance director will evaluate tenants’ applications and financial resources, and will make recommendations to the commission. 184. Approve a policy regarding construction of tenant improvement/building? This policy provides the minimum criteria the port will consider before the port constructs a building or improvement for a tenant. It includes project impact on sustainability, competitiveness, and employment of a tenant’s business. (6352/Action Item 4) Approved 3-0

185. Authorize the executive director to sign a $903,792 contract with Razz Construction of Bellingham for multiple fire suppression and domestic water projects? The projects will replace the fire main and domestic water mains at the Bellingham Cruise Terminal, install a backflow preventer on Harris Avenue at the cruise terminal site, replace the sewer line and sprinkler systems in buildings #2 and #4 at the Fairhaven Marine Industrial Park and the sprinkler system at the Esplanade building. A contingency fee of $91,208 brings the total contract to $995,000. (6365/Consent Agenda B) Approved 3-0

186. Authorize the executive director to increase by $65,488 the contract with IMCO General Construction of Bellingham for the airport paving project? The contract was initially approved at the 7/19/2016 meeting, vote #126. A Federal Aviation Administration inspection identified several areas of failed pavement outside the scope of the initial contract. These include runway ends, taxiway shoulder areas, and the commercial apron. Correction of these deficiencies through a change order to the existing contract will be most expedient. This contingency increases the total authorized contract to $1,866,420. (6366/Consent Agenda C) Approved 3-0

187. Authorize the executive director to sign an agreement with the city of Bellingham and Whatcom County for funding and contracting with economic development services? The agreement continues a coordinated approach to economic development funding through 2019. Services include business retention, business expansion, assistance to start-ups, research and data support, and marketing efforts. The yearly port commitment is $66,250 in 2017, $71,850 in 2018, and $73,650 in 2019. The port contributes 25 percent of the funding. Total three year cost for the city, county and port is $847,000. 188. Authorize the executive director to sign a three-year service agreement with Western Washington University to fund Small Business Development Center services? In 2011, the port joined with the city of Bellingham and Whatcom County to help fund the development center. Services include business retention, business expansion, assistance to start-ups, research and data support, and marketing efforts. The yearly city, county and port commitment is $225,000 in 2017, $247,400 in 2018 and $254,600 in 2019. The total three year commitment is $847,000. (6357/Action Item 2) Approved 3-0

189. Incorporate the capital projects contained in the 2017 strategic budget into the Comprehensive Scheme of Harbor Improvements? This vote updates the 2016 Comprehensive Scheme of Harbor Improvements. It describes existing and proposed facilities, infrastructure, uses and opportunities for properties owned or managed by the port. They are: Blaine wharf district master plan, Sumas international cargo terminal, Bellingham airport master plan, Squalicum Harbor improvements, Waterfront District sub-area plan and Fairhaven Harbor improvements. 6369/Action Item 3 (Resolution 1355) Approved 3-0

190. Authorize the executive director to increase by $142,421 the contract contingency with Ram Construction of Bellingham for work on the Bellingham Shipping Terminal stormwater improvements project? The original contract was approved at the 9/8/2016 meeting, vote #153. The increased contingency fee will cover site preparation for an incoming tenant that includes rumble strips, fencing, stormwater drainage, and decommissioning of monitoring wells. Over excavation and additional imported fill is required due to existence of quarry rock that cannot be graded. The 9 percent contingency increases the total authorized contract amount to $1,883,122. 191. Authorize the executive director to sign a $275,374 agreement with Puget Sound Energy of Bellevue for work related to the All American Marine Manufacturing facility project? For details on the 57,000 square foot boat manufacturing facility, see the 5/3/2016 meeting, vote #77, 78, 79, 81 and 82. Puget Sound Energy will provide and install materials to replace overhead power utilities with underground power utilities. Currently, overhead power and communications lines on the south side of Hilton Avenue block use of the facility, currently under construction. The purchase order includes all materials (vaults, conduit, and conductors), installation of conductors, and removal of existing overhead lines and poles. The port’s contractor will install the vaults and conduit. (6360/Action Item 5) Approved 3-0

192. Establish a small works roster process for public works contracts up to $300,000? Port staff intends to use the small works roster for small scale projects and will establish an on-call contractor for routine, repetitive work. Contracts for $150,000 or larger will be brought before the commission for approval; contracts smaller than $150,000 will be within the executive director’s spending authority. Public works contracts requiring commission approval will increase from $25,0000 to $150,000. 6361/Action Item 6 (Resolution 1358) Approved 3-0

193. Approve the 2017 strategic budget? (Public hearings held on 11/1 and 11/15.) The 2017 draft budget estimates a property tax levy collection of $7,062,581. 6363/Action Item 8 (Resolution 1356) Approved 3-0

194. Adopt the 2017 property tax levy? The 2017 property tax levy is $.2768 per 1,000 of assessed valuation and the tax income is estimated at $7,063,581. The levy will be used to pay operating expenses, debt service, and capital costs.
