73. Authorize the executive director to sign a $263,347 contract (amendment #1) with Pacific Security of Bellingham to provide security services? This amendment will provide a 2.3 percent increase in the billing rate. The contract runs from 6/1/2016 through 5/31/17 and can be renewed for another year. This amendment brings the total contract amount to $520,806. (5803/Consent Agenda B) Approved 3-0

74. Authorize the executive director to sign a $555,896 contract (amendment #43) with Anchor QEA of Seattle for work related to the closeout of Phase 1 of the Whatcom Waterway clean-up project? Scope of work includes state Department of Ecology required production and submission of the construction closeout report, the Nationwide 38 permit and state-approved engineering design report (and its sampling and analysis plan) regarding the requirement to conduct the initial post-construction environmental monitoring report. This amendment is for May through December 2016 and brings the total contract amount to $12,435,235. (5804/Consent Agenda C) Approved 3-0

75. Authorize the executive director to sign a $78,000 contract (amendment #2) with Wilson Engineering of Bellingham for additional work on the C Street Terminal Project? Additional work is required due to modification of design elements of the site. Solving design issues of the barge ramp and its relationship to alternatives for the planned permanent support and lift structure led to added complexity and corresponding design effort. This amendment also provides for construction support services for fabrication of the barge ramp. The contract period is 120 calendar days, providing a construction period of May through August 2016. This amendment brings the total contract amount to $613,000. (5806/Consent Agenda E) Approved 3-0

76. Approve a license to operate agreement with Rasier LLC of Delawareoperating as Uber® at the Fairhaven Terminal? This agreement is similar to the agreement the port has with Rasier at the Bellingham airport (2/2/2016 meeting, vote #39) in terms of fees and other requirements. The port will receive $1.50 per pick-up trip and $1.50 per drop-off trip for the Bellingham Cruise Terminal and Fairhaven Station. (5807/Consent Agenda F) Approved 3-0

77. Authorize the executive director to sign a $306,494 contract (amendment #5) with Carletti Architects of Mount Vernon to provide construction administration support for the All American Marine manufacturing facility? Scope of work includes construction administration; tenant-requested design changes; construction surveying and staking; completion of as-built record drawings; historical assessment of the Fairhaven site; Hilton Avenue regrading; and design of the landfill gas collection system. This amendment brings the total authorized contract amount to $912,923. (5808/Consent Agenda G) Approved 3-0

78. Authorize the executive director to sign a $35,230 contract with Materials Testing & Consulting of Burlington to perform special inspections during the construction of the All American Marine manufacturing facility? As adopted by the Bellingham Municipal Code, the 2012 International Building Code requires an approved agency to conduct special inspections of elements of the construction process. Materials Testing & Consulting was selected based on its ability to provide all of the necessary special inspections at the most competitive cost. (5809/Consent Agenda H) Approved 3-0

79. Authorize the executive director to sign a $97,705 contract (amendment #11) with Anchor QEA of Seattle for construction management and interim action reporting at the Central Waterfront site? The Department of Ecology has determined that portions of the site where the All American Marine facility will be constructed (near Hilton and Roeder Avenues) represent an interim action under the Model Toxics Control Act. Construction must accomplish certain cleanup objectives. Scope of work covers construction management and reporting associated with cleanup of the site. This amendment brings the total authorized contract amount to $922,335. (5810/Consent Agenda I) Approved 3-0

80. Authorize the executive director to sign a master development agreement (amendment #2) with Harcourt Development of Dublin, Ireland? Amendment #2 extends the timing for completion and submittal of a building permit for the second building project by six months to 11/19/2016. Harcourt has indicated interest in developing the Board Mill Building as its second project. Currently, the Board Mill Building is within the Western Crossing parcel; however, Western Crossing has not expressed interest in reutilizing the Board Mill Building. Amendment #2 does not impact any other schedule components or the required completion date for the construction of the second development project. (5816/Action Item 2) Approved 3-0

81. Authorize the executive director to award the low bid of $8,873,713 to Ram Construction of Bellingham for construction of the All American Marine manufacturing facility? The port has worked with the company to design a 57,000 square foot manufacturing facility off Hilton Avenue. The project includes relocating approximately 46,000 cubic yards of fill to the Cornwall site; installing a landfill gas collection system under the building; constructing a grade-beam supported concrete slab and steel-framed building; completing all exterior site work; and building public frontage improvements along Hilton Avenue. The expected completion date is 12/31/2016. The contract includes a contingency fee of $443,287 for a total authorized contract of $9,317,000. The work was advertised and five bids were received. 82. Authorize the executive director to sign a $123,200 contract (amendment #3) with Landau Associates of Edmonds to perform construction management and reporting at the Cornwall Avenue landfill site? The port sold 49 percent of the landfill (11/15/2005 meeting, vote #111) to the city of Bellingham for $2,450,000. The property is located at the foot of Cornwall Avenue and requires remedial action under the Model Toxics Control Act. As part of the Department of Ecology selected cleanup, a landfill capping system will be constructed to contain the municipal refuse and wood waste in place. General fill will be imported to the site to establish drainage grades and to provide preload for construction of the final cover system. Material located at the All American Marine construction site on Hilton Avenue has been authorized by Ecology for use at the Cornwall site. Scope of work is to oversee and document that construction activities are completed in accordance with Ecology cleanup requirements. The costs will be divided between the port 12.5 percent, state 12.5 percent and city of Bellingham 75 percent. This amendment brings the total contract amount to $839,390. 83. Authorize the executive director to sign a $30,200 contract (amendment #13) with BergerABAM of Federal Way to design immediate and interim repairs for the Harris Avenue pier replacement project? Immediate repairs will keep the pier safe for use in its current capacity, and will be completed in-house. The second, or interim, repair will go out to bid and will be designed to sustain use of the pier until the replacement project can occur sixteen months from now. This amendment brings the total contract amount to $1,396,257. (5815/Action Item 5) Approved 3-0

84. Rename the Blaine End Pier the “Jorgensen Pier?” Renaming the pier honors recently retired port commissioner Jim Jorgensen. The port facility is located on Department of Natural Resources tidelands at the end of Blaine Marine Drive. Commissioner Jorgensen advocated restoring vehicle access to the pier; the port and the city of Blaine are seeking funding to improve public access to the pier. 5811/Action Item 1 (Resolution 1352) Approved 3-0

85. Authorize the executive director to sign a $50,000 contract with BergerABAM of Federal Way to provide consulting services for the 2016 condition surveys at the Bellingham Cruise Terminal and Squalicum Harbor? The structural elements at the cruise terminal will be evaluated, also the ferry slip, the general condition of mechanical and electrical utilities. The structural elements at the sawtooth pier located in Squalicum Harbor will also be evaluated. The inspection team will be led by a registered marine design engineer. A contingency fee of $6,000 brings the total contract to $56,000. (5822/Action Item 1) Approved 3-0

86. Authorize the executive director to sign a $30,330 contract with Pacific Surveying & Engineering of Bellingham to provide consulting services for the airport sidewalks and LED lighting project? Design and permitting under this project provides 1,500 feet of new sidewalk along the east side of Mitchell Way, north from West Bakerview Road to the roundabout. The Holiday Inn hotel is constructing their portion of the sidewalk. The port is required to construct the sidewalk under the general binding site plan with Whatcom County. The LED lighting upgrade consisting of six street light poles and LED fixtures along the west side of Mitchell Way and four at the roundabout. A $3,670 contingency fee brings the total contract to $34,000. (5824/Consent Agenda B) Approved 3-0

87. Authorize the executive director to sign a $455,610 contract (amendment #5) with Aspect Consulting of Seattle for construction management and oversight services for the pulp/tissue cleanup at the GP West site? The contract was first approved at the 12/2/2014 meeting, vote #149. The 74-acre site is divided into the pulp/tissue and chlor-alkali remedial action units. The 31-acre pulp/tissue unit cleanup includes the removal of petroleum impacted soil, monitored natural attenuation of contaminated groundwater. Amendment #5 includes a wide capping project, preparation of a post-construction as-built report, development of a cap inspection and maintenance plan, and a year 1 groundwater monitoring and associated reporting. This amendment brings the total contract to $1,032,627. (5825/Consent Agenda C) Approved 3-0

88. Authorize the executive director to sign a $56,844 contract with Associated Project Consultants of Bellingham to provide consulting services for multiple fire and domestic water projects? The contract includes design and engineering for six fire and domestic water projects: Blaine boathouse water pressure line; Bellingham Cruise Terminal fire and domestic watermains; Fairhaven backflow prevention device; Fairhaven Marine Industrial Park sewer line and sprinklers for Building #2; and Squalicum Esplanade sprinklers. A $6,156 contingency fee brings the total contract to $63,000. (5826/Consent Agenda D) Approved 3-0

89. Authorize the executive director to sign a $270,050 contract (amendment #9) with Kennedy/Jenks Consultants of Federal Way for final design and bid documents pertaining to Bellingham Shipping Terminal stormwater improvements? The contract was first approved at the 5/5/2014 meeting, vote #66. The port secured a $1.5 million state grant (5/5/2014 meeting, vote #59) from the Environmental Legacy Stewardship Account to improve the quality of stormwater effluent at the shipping terminal. The port has budgeted an additional $85,000 for planning of future facilities at terminal. These efforts have been combined for cost efficiency. Amendment #9 provides design and bidding documents for approximately 12 acres. This amendment brings the total contract to $519,754. (5827/Consent Agenda E) Approved 3-0

90. Renew a lease with Puget Sound Energy of Bellevue for property located at Squalicum Harbor? Puget Sound Energy has been leasing property on Roeder Avenue since 1966 for an electrical power distribution substation. The most recent lease expired 4/30/2016. The five-year lease terminates on 4/30/20121; rent over the five-year renewal period will be $101,170. (5828/Consent Agenda F) Approved 3-0

91. Cancel a lease with Stork Craft Manufacturing? Stork Craft (with headquarters in Richmond, B.C.), the world’s largest supplier of juvenile furniture, no longer has a need for its 210,000 square foot Bellingham warehouse at 1000 F Street that was used for storage and distribution of furniture manufactured in Asia. It is moving to a 400,000 square foot warehouse in California so it will not be renewing its lease that expires on 6/30/2016. Stork has paid the port over $6 million in rent since 2008. (5829/Consent Agenda G) Approved 3-0

92. Authorize the executive director to sign a $85,296 contract with Anchor QEA of Seattle to provide consultant services for the 2016 port-wide storm damages project? In January, February and March 2016 severe wind and storm surges damaged port shoreline properties in seven locations from Fairhaven to Squalicum Creek. The port has notified its insurance carrier that a claim and “Work for Others” account has been established to capture and recover costs associated with this storm damage. This permitting and design work will provide seven constructible drawings. A $8,704 contingency fee brings the total contract to $94,000. (5830/Consent Agenda H) Approved 3-0

93. Authorize the executive director to sign a federal grant agreement for damage that occurred during the 8/29/2015 windstorm? The Federal Emergency Management Agency declared the windstorm a major disaster. Destruction of the roll up door at Bellingham Shipping Terminal Warehouse #2 was deemed eligible for federal funds. A new roll up door was purchased for $5,176. Signing the agreement will allow the port to recover $4,529. (5831/Consent Agenda I) Approved 3-0

94. Authorize the executive director to award the low bid of $1,999,473 to RAM Construction of Bellingham for the GP West Capping Project? Under a consent decree with the state of Washington (7/1/2014 meeting, vote #96), the port is required to install a “human contact” cap to the impacted soils on the 31 acre northern portion of the Waterfront District. The Capping Project will control exposure to contaminated soils by regrading portions of the site, importing clean fill capping material, and constructing a new asphalt hard caps. A Model Toxics Control Act grant will reimburse 50 percent of the costs and the rest through an insurance policy. A $300,527 contingency fee brings the total contract to $2,300,000. The work was advertised and five bids were received. (5832/Action Item 2) Approved 3-0

95. Authorize the executive director to sign an agreement with the city of Bellingham for reimbursement of costs for site grading at the Waterfront District? The city (5/16/2016 meeting, vote #76) has requested that the port move and grade a one-acre site immediately west of the Granary Building in anticipation of the city’s Granary Avenue road construction project. The port will spend $27,000 for site grading and will be reimbursed by the city. The agreement establishes a mechanism for the city to reimburse the port for this work. 96. Authorize the executive director to sign a $140,512 contract with Carletti Architects of Mount Vernon for Lignin Building improvements? The Lignin Building, a 55,000 square-foot steel building that was constructed in 1964, was formerly used by Georgia-Pacific for processing and packaging lignin, a byproduct of tissue production. The building lacks electrical power, water service, sewer service, restrooms, fire sprinklers, and ceiling insulation so it needs lighting, heating, ventilation, and cooling system updates. The goal of this project is to prepare the building to be leased by tenants as warehouse/manufacturing space. This contract includes planning, designing and permitting for proposed improvements to the building. (5834/Action Item 4) Approved 3-0
