Shall the commission:
133. Small Works Roster. Contracts under $300,000 fall within the executive director’s spending authority; they only require commission notification. Re-stripe Bellingham Cruise Terminal lots, $149,424. (7851/Consent Agenda B)

134. Authorize the executive director to sign a $57,060 contract (amendment #2) with RMC Architects of Bellingham for design, permitting and estimating support for the Blaine Marine Industrial Area building? At the 3/20/2018 meeting, vote #40, the commission approved a $245,735 contract with RMC Architects for three projects in Blaine. Amendment #1 was for $24,390, and included a site survey, geotechnical investigations and preparations of the shoreline substantial development permit for the area building. This amendment is for the remaining design, permitting and bidding steps. Estimated construction costs for the building are $543,700. (7852/Consent Agenda C) Approved 3-0

135. Approve a terminal services agreement (amendment #5) with the state of Alaska? Bellingham has been the terminus for the Alaska ferry since 1989. The services agreement for the Alaska ferry (Alaska Marine Highway System) includes staffing for ticketing, reservations, vehicle embarking and disembarking and janitorial services for ferries. This amendment runs from 10/1/2018 through 9/30/2021. The contract will generate $202,061 the first year and increase 3 percent annually. (7854/Consent Agenda E) Approved 3-0

136. Increase the weekend booking time at the Bellingham Cruise Terminal Dome Room to 90 days? Currently the date needs to be booked 60 days before the scheduled event. The weekend rates (8 a.m. to midnight) vary from $2,400 for the upper level on Saturday during the peak season (June to December) to $900 for the dome and lounge on Friday and Sunday during the off-season (January to May). 137. Increase the budget by $74,388 for two unrelated projects at the Bellingham airport? Four electric vehicle charging stations will be installed in the main parking lot. Electrical work is needed to create an operations control center on the second floor of the passenger terminal (7866/Consent Agenda K) Approved 3-0

138. Increase the contract with Razz Construction of Bellingham by $50,000 for district energy piping? Complicated subsurface conditions are continuing in the Granary Avenue and Laurel Street project. This vote will increase the contract from $843,446 to $993,446. Complicated subsurface conditions caused the budget to be increased by $143,310 at the 8/14/2018 meeting, vote #117. (7863/Consent Agenda L) Approved 3-0

139. Authorize the executive director to negotiate and/or sign memorandums of understanding with Dakota Creek Shellfish, Boundary Fish Company, Drayton Harbor Fishery and Walsh Marine regarding property at the Blaine Marine Industrial Area? The Blaine Marine Industrial Area is home to several fish transfer and processing facilities, a boatyard as well as the sawtooth dock and weblocker. The port has begun redeveloping the area, demolishing a building, pier and bulkhead repairs. The businesses that are signing the memorandums of understanding expressed an interest in leasing property and expanding their leaseholding in the Marine Industrial Area. Properties in the area are not available, but the memorandum will allow the businesses to identify the location of properties to lease, indenifying size and infrastructure needs. 140. Approve a lease with the Non-GMO Project for Suite 301, Bellwether Building? First American Title Insurance Company had a lease on Suite 301 until 1/31/2021; the company vacated the property in April of 2017. The termination of lease required First American to pay the first two months of the Non-GMO Project’s base rent. The Non-GMO Project began in 2007 when two grocery stores created the nonprofit organization to provide their customers with information about GMOs (genetically modified organisms). The Product Vertification Program has grown steadly since, with more than 3,000 certified brands, representating over 43,000 products. Rent for the five-year lease is $755,933. Approved 3-0

141. Authorize the executive director to renew the port’s liability and auto insurance coverage? The premium will be $186,232 from 10/1/2018 through 9/30/2019. Alliant Insurance Services of Newport Beach, California, will continue to serve as the broker of record. The 2017-2018 premium was $183,096. (7884/Consent Agenda B) Approved 3-0

142. Authorize the executive director to sign the Disadvantaged Business Enterprise Program for the Bellingham airport? The federal government requires airports that exceed the monetary threshold of $250,000 in gross revenue each each year to maintain a Disadvantaged Business Enterprise Program. The purpose of the program is to ensure equal opportunity to receive and participate in federally funded contracts and the nondiscrimination in awarding contracts. (7886/Consent Agenda D) Approved 3-0

144. Adopt Bellingham airport rules and regulations? (Public hearing held.) The previous rules and regulations were adopted in 1997. The news rules and regulations were developed in accordance with FAA regulations and policies, the International Fire Code, state and local codes, airport tenants, local pilots, port advisory committees and national aircafter owners’ and pilots’ associations. (Resolution 1379) 7897/Action Item 1 Approved 3-0

Action Taken at October 16, 2018 Meeting

Shall the commission:
145. Authorize the executive director to sign a $27,424 contract (amendment #4) with Ashton Engineering of Bellingham for the next phase of the I&J Waterway pier and float project? At the 3/1/2016 meeting, vote #54, the commission approved the initial contract for consulting services for the float project. The float will be used by All American Marine as a fit-up float for newly produced boats. A contingency fee of $2,724 brings this amendment to $30,166 and the total contract to $346,204. (7922/Consent Agenda E) Approved 3-0

146. Authorize the executive director to award the low bid of $232,072 to Dormakaba USA of Lancaster, Penn., to manuacture and install a double automated secure exit lane at Bellingham airport? Security guards currently ensure no unauthorized access to the terminal through the exit lane (which the federal government funds 16 hours per day). If federal funding is eliminated, the port would absorb the entire cost. The automated security lane will eliminate the need for security guards. Two bids were received, the high bid was $325,500. (7911/Action Item 1) Approved 3-0

147. Authorize the executive director to sign change order no. 1 for the Blaine Harbor settlement monitoring project in the amount of $32,326? Under the Small Works Roster, a contract for $299,910 was awarded to Faber Construction of Lynden for the Blaine Harbor monitoring project. Soil under the site was deemed structurally unsuitable requiring replacement and increasing the contract above the Small Works Roster ceiling of $300,000. The total amended contract is $332,236. (7912/Action Item 2) Approved 3-0

148. Authorize the executive director to sign an agreement with the state of Washington to provide management services for renewble energy production services? The first project will be the installation of solar panels at the Bellingham Cruise Terminal. A detailed audit will deterine energy savings and the maximum cost of the project. The port will be eligible for a state grant that will pay for 50 percent of the project costs. (7913/Action Item 3) Approved 3-0

149. Authorize the executive director to hire the law firm Lamb & Lerch of New York City to apply for foreign trade zone designation? Fees for this service come to $17,250. The areas covered will be the Bellingham Shipping Terminal and log pond. It is anticipated that Canada will be the utimate destination for much of the cargo unloaded by Ports American in Bellingham. Goods stored are not subject to customs duties. (7915/Action Item 5) Approved 3-0

150. Authorize the executive director to sign a $75,000 sole source contract with Heartland LLC of Seattle to update the Cherry Point Industrial Development District feasibility study? The 1998 study was prepared by Heartland LLC; the company will update the study and research the feasibility of developing a business/industrial park at Cherry Point with the purpose of attracting new investment and jobs. The cost of the 1998 study was $250,000, the update will be $75,000. (7916/Action Item 6) Approved 3-0

151. Sign a contract with Ports America covering stevedore services at the Bellingham Shipping Terminal? Ports America is the Washington state division of West Coast Terminal and Stevedore Company. The contract allows Ports America exclusive stevedoring rights for loading/unloading trucks, rail and ocean vessels with some steel products, forest products, metal/aluminum ingots, modules, oversized and project cargoes. All land and the log pond area will remain under the control of the Port of Bellingham. (7923/Action Item 4) Approved 3-0
